1. Data Controller

In compliance with the duty to inform set out in Law 81 of 26 March 2019 on the Protection of Personal Data of the Republic of Panama, and its implementing regulations, we inform you that Ergonómica, a trade name of Ergo Life S.A., domiciled in Panama City, Republic of Panama, is the controller of the personal data collected through the website ergonomicadesk.com.

For any matter relating to your personal data you may write to ventas@ergonomicadesk.com with the subject "Protección de Datos".

2. What We Collect, and What For

We collect only the data needed for the purposes described below. You do not need an account to buy.

• Order and delivery data: first and last name, email address, telephone or WhatsApp number, delivery address and location references. Purpose: to process the order, arrange delivery or pickup, and contact you about that purchase.
• Payment data: your card details are entered directly into the payment gateway's own form and replaced by a token. Ergonómica does not store your full card number.
• Browsing data: pages visited, products viewed, device and session identifiers, and IP address. Purpose: to measure use of the site, detect errors, and measure advertising performance.
• Sales contact data: the messages you send us by WhatsApp or email, and the product or order reference they concern.

3. Processors and International Transfers

To provide the service we share personal data with providers who process it on Ergonómica's behalf and on its instructions. These providers supply infrastructure and operational services, and several are domiciled outside the Republic of Panama, principally in the United States of America. This involves an international transfer of data.

The categories of processor are:

• Payment processing: receives the data needed to authorise and capture the transaction.
• Hosting and infrastructure: hosts the site, the order database and media files.
• Transactional email: sends the order confirmation and the associated internal notifications.
• Content management: stores the site's text and images; it receives no customer data.
• Web analytics: measures use of the site in aggregate.
• Advertising and campaign measurement: receives interaction and purchase events, including pseudonymised identifiers, to attribute and measure campaigns.
• Bot and abuse protection: verifies that the person completing payment is a human being.
• Error reporting: receives technical information about the failure when the site errors.
• Messaging: when you choose to continue the conversation on WhatsApp, that conversation is governed by the messaging provider's own terms.

4. Retention

Data associated with an order is retained for the period required by Panamanian commercial and tax law for the documentation of a sale, and for as long as warranty obligations or possible claims arising from that purchase subsist.

Browsing data is retained for each measurement tool's own retention period. Contact messages are retained for as long as they are needed to deal with your enquiry.

5. Your Rights

Law 81 of 2019 grants you the rights of access, rectification, cancellation, objection and portability over your personal data.

You may exercise them by writing to ventas@ergonomicadesk.com with the subject "Protección de Datos", stating which right you wish to exercise and attaching a document evidencing your identity. We will reply within the period provided by law.

If you consider that your request has not been dealt with properly, you may apply to the National Authority for Transparency and Access to Information (ANTAI), the competent authority for personal data protection in the Republic of Panama.

6. Cookies and Tracking Technologies

The site uses first-party cookies, which are necessary for the cart and the purchase session to work, and third-party cookies and identifiers for analytics and advertising, as described in section 3.

You can configure your browser to refuse cookies. The cookies needed for the cart and the payment process cannot be disabled without affecting your ability to complete a purchase.

7. Security

Ergonómica applies reasonable technical and organisational measures to protect personal data against loss, misuse and unauthorised access. The site is served entirely over an encrypted connection and card details are not stored on our systems.

No security measure is absolute; we cannot guarantee that an incident is impossible.

8. Users and Use of the Site

Accessing and using the site confers the status of User and implies acceptance of the conditions in this document. The User warrants that the data they provide to Ergonómica is genuine and current, and is solely responsible for any false or inaccurate statements they make.

The User undertakes to make proper use of the content and services, and not to use them to distribute content contrary to law or public order, nor to introduce viruses or take actions that could damage the systems of Ergonómica or of third parties.

9. Intellectual and Industrial Property

Ergonómica owns or licenses the intellectual and industrial property rights in the site and in the elements it contains, including images, text, trade marks, logos, design and the software necessary for its operation.

Reproduction, distribution and public communication of all or part of the content for commercial purposes, in any medium and by any means, is prohibited without Ergonómica's authorisation.

10. Exclusion of Warranties and Liability

Ergonómica is not liable for loss or damage arising from errors or omissions in the content, from unavailability of the site, or from the transmission of malicious software, notwithstanding that reasonable technical measures have been taken to prevent it.

This exclusion does not affect the rights that Panamanian consumer protection law grants the buyer in respect of the products purchased.

11. Changes

Ergonómica may amend this document to reflect changes in the service or in applicable law. The version in force is the one published on this page, bearing the update date shown above.

12. Governing Law and Jurisdiction

The relationship between Ergonómica and the User is governed by the law of the Republic of Panama. The Courts and Tribunals of Panama City have jurisdiction over any dispute.

13. Language

This policy is published in Spanish and in English. The Spanish version governs; the English translation is provided for ease of reading only.
