Terms and Conditions

1. Purpose and Scope

These Terms and Conditions govern access to and use of the website ergonomicadesk.com, owned by Ergo Life S.A., trading under the commercial name Ergonómica, domiciled in Panama City, Republic of Panama.

Accessing the website implies full and unreserved acceptance of every term and condition set out in this text. A user who does not agree with these terms must refrain from using the website.

2. Intellectual Property Rights

All website content — including text, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as its graphic design and source code — is the intellectual property of Ergonómica or of third parties who have authorised its use. No exploitation right recognised by applicable intellectual property law is assigned to the user.

3. Use of the Website

The user undertakes to use the website, its content and its services in accordance with the law, these Terms of Use, morality and good customs. By way of example and without limitation, the user undertakes not to:

• Reproduce, copy, distribute, make available, otherwise publicly communicate, transform or modify the content.
• Remove, circumvent or manipulate the copyright and other data identifying reserved rights.
• Use the website's content and services to carry out advertising, propaganda or other commercial activities.
• Use the website for illegal or unauthorised purposes.

4. Licence over Communications

Where the user sends information of any kind to Ergonómica through the channels provided, the user declares, warrants and accepts that they are free to do so and that such information infringes no intellectual property, trademark, patent, trade secret or any other third-party right.

5. Liability and Warranties

Ergonómica does not guarantee the absence of interruptions or errors in access to the website or its content, nor that it is up to date, although it will use its best efforts to avoid, remedy or update them as the case may be.

Ergonómica shall not be liable for any damage or loss arising from interference, omissions, interruptions, computer viruses, telephone faults or disconnections in the operation of this electronic system caused by matters beyond Ergonómica's control.

6. Purchase Process

Prices shown on the website are expressed in United States dollars (USD). Displayed prices are net: the 7% ITBMS is calculated and added at checkout. The tax appears as its own line in the cart and at checkout, so the amount to be charged is shown in full before payment is confirmed. Ergonómica reserves the right to modify prices at any time; the prices that apply are those in force at the moment the order is placed.

Pay by Yappy (Banco General), ACH or bank transfer, or on delivery by card or Yappy for orders under $500. Orders of $500 or more require a 50% deposit. We coordinate payment by WhatsApp after you confirm your order.

Once the order is placed, the user will receive confirmation by email. Ergonómica accepts no liability for errors made by the user when entering the order details.

7. Consumer Goods Warranty

Ergonómica answers to the consumer as the supplier, under Law 45 of 2007 on consumer protection: the buyer does not have to pursue a claim with the manufacturer. Where a manufacturer offers a longer term than the one published for a product, Ergonómica honours the longer term. Warranties of 1 to 5 years depending on the product. The warranty covers manufacturing defects under normal use conditions; it does not cover misuse. Each product's term is shown on its own page. Where a product page states no term, no warranty period is promised for that product and the user should ask before purchasing.

8. Returns

We accept returns up to 7 calendar days after delivery. The conditions, exclusions and procedure are set out in the Returns Policy.

9. Third-Party Links

The website may contain links to other internet sites not operated by Ergonómica. Ergonómica has no control over those sites and assumes no responsibility for the content, privacy policies or practices of third-party sites.

10. Term and Modification

Ergonómica may modify the terms and conditions set out here at any time, duly published as they appear here. Those conditions remain in force from their publication until replaced by others duly published.

11. Governing Language

This English text is a translation provided for convenience. In the event of any discrepancy between the two versions, the Spanish version prevails.

12. Jurisdiction

These conditions are governed by the law of the Republic of Panama. For the resolution of any dispute arising from the interpretation or performance of these conditions, the parties submit to the Courts and Tribunals of Panama City, expressly waiving any other jurisdiction that might correspond to them.
